Anisul Islam Moves to Take Control of Jatiya Party, GM Quader Actively Opposes

Following the lifting of a court injunction and the holding of a conference, two factions of the Jatiya Party (JAPA), led by GM Quader and Anisul Islam Mahmud respectively, are actively vying for control of the party. Both sides have approached the Election Commission (EC) to assert their authority.

After organizing a conference and forming a new committee, Anisul Islam’s faction has sought to amend the party’s constitution and gain the EC’s recognition, including the right to use the party’s "plough" symbol and its registration. Meanwhile, GM Quader has declared the entire process, including the conference and committee formation, as illegal and has formally informed the EC of his stance.

According to reliable sources, Anisul Islam’s faction, following the Jatiya Party’s "10th Council," submitted a letter to the EC secretary with details of the newly elected leadership. The letter also proposed abolishing the controversial Article 20/1/Ka of the party’s constitution, which grants the chairman absolute authority over decisions. Anisul’s faction has amended this article to mandate that decisions regarding the expulsion or suspension of central members, as well as the dissolution of district or unit committees, must be approved by the party’s presidium. They also emphasized that any expulsion or suspension by the chairman requires the presidium’s approval. The faction has sought EC recognition for these constitutional amendments made through the conference.

On August 10, the day after the conference, Anisul Islam’s faction submitted a list of the top four leaders of the newly elected committee to the EC. Claiming to represent the "mainstream" Jatiya Party, they asserted their exclusive right to use the "plough" symbol. Sources indicate that they are preparing to send a legal notice to GM Quader, demanding control of the party’s office and funds, and prohibiting him from using the party’s registration number 12.

On the other hand, a leader from GM Quader’s faction visited the EC office in Agargaon, Dhaka, on Wednesday and submitted a letter. The letter reportedly cited various provisions of the party’s constitution, stating that those who called the conference had already been expelled from the party. It further argued that only the chairman has the authority to convene a conference, rendering the process and the resulting committee illegal.

On August 9, Anisul Islam Mahmud, acting chairman, and Mujibul Haque (Chunnu), general secretary, held the Jatiya Party’s "10th Council" at a venue in Gulshan, Dhaka. At the conference, Anisul Islam was elected chairman, Mujibul Haque as executive chairman, Kazi Firoz Rashid as senior co-chairman, and ABM Ruhul Amin Howlader as general secretary. However, GM Quader had previously expelled them from the party’s primary membership and other positions. In response, Anisul Islam and nine other leaders filed a case in Dhaka’s First Joint District Judge Court against GM Quader and joint office secretary Mahmud Alam. The court imposed a temporary injunction until August 12, prohibiting organizational activities by GM Quader and Mahmud Alam. Despite this, Anisul Islam’s faction held the conference and formed the new committee on August 9.

August 12 marked the end of the court’s temporary injunction on GM Quader. On the same day, the plaintiffs applied to withdraw the case. Due to procedural issues, the case was transferred from the First Joint District Judge Court to the Sixth Joint District Judge Court on August 11. On August 12, the judge granted the withdrawal application, lifting the injunction on GM Quader and Mahmud Alam’s organizational activities.
