The bench, comprising Justices M.M. Sundresh and N. Kotiswar Singh, dismissed the woman’s plea to cancel the anticipatory bail granted to the accused. The woman’s lawyer argued that the accused had established a physical relationship with her under the false promise of marriage. However, the court countered, stating, “You are married, a mother of two children, and an adult. You must have understood that this was an extramarital affair.”
The lawyer further stated that the accused had repeatedly invited the woman to hotels. The court responded, “Why did you go to the hotel multiple times? You must be aware that you, too, committed an offense by engaging in an extramarital physical relationship.”
The two individuals met through social media in 2016 and developed a romantic relationship. The woman alleged that under pressure from the accused, she divorced her husband, with the divorce being finalized by a family court on March 6 this year. However, when the accused refused to marry her post-divorce, she filed a rape complaint with the Bihar Police, claiming he had engaged in a physical relationship under the false promise of marriage.
The court noted that no physical relationship occurred between the two after the divorce. Based on this, the Patna High Court had previously granted anticipatory bail to the accused, a decision upheld by the Supreme Court.
